![]() North Dakota Seeks Minnesota's Help in Resolving Issues with the NGA Posted on 2/18/2010 Letter sent to Minnesota legislators from ND Industrial Commission North Dakota officials sent a letter to Minnesota legislators last week re-stating North Dakota's concerns with Minnesota's Next Generation Energy Act of 2007 and seeking Minnesota lawmakers' cooperation in developing a legislative solution to the cross-border commerce restrictions. This follows reports over the past few months of North Dakota's potential legal action against Minnesota in regard to the NextGen Act. The letter was sent as an effort to call attention to the legal problems with the policy and to express their interest in working with the Minnesota legislature to find solutions. North Dakota is most concerned about the provision that established a moratorium on the importation of new coal from other states suggesting it violates interstate commerce laws. North Dakota officials have attempted to reach a compromise with the Minnesota Attorney General as well as representatives from Gov. Pawlenty's office. In the letter, the Industrial Commission re-stated their interest in maintaining the decades-old energy partnership between the two states and avoiding legal action. The State of North Dakota and the Lignite Energy Council will continue to seek opportunities to find reasonable policy solutions to address the problems within the NextGen Act during the 2010 legislative session. |
